Introduction

On July 15, 2024, Delta 9 Cannabis Inc., Delta 9 Bio-Tech Inc. (“Bio-Tech”), Delta 9 Lifestyle Cannabis Clinic Inc., Delta 9 Cannabis Store Inc., and Delta 9 Logistics Inc. (collectively, the "Companies") were granted an initial order (the “Initial Order”) by the Court of King’s Bench of Alberta (the “Court”) under the Companies’ Creditors Arrangement Act, RSC 1985, c. C-36, as amended (the “CCAA”). 

The Initial Order was granted by the Honourable Mr. Justice Mah of the Court of King’s Bench of Alberta. Alvarez & Marsal Canada Inc. was appointed pursuant to the CCAA as monitor (the “Monitor”).

The Initial Order granted a stay of proceedings until July 24, 2024 (the "Initial Stay Period") and other relief sought by the Companies.   An amended and restated initial order (“ARIO”) was granted by the Honourable Associate Chief Justice K.G. Nielsen on July 24, 2024, extending the Initial Stay Period to September 15, 2024, along with various other relief.

In addition to the ARIO, the Court granted orders approving a sales and investment solicitation process (“SISP”) for the Bio-Tech business and assets and a claims procedure. The bid deadline for the Bio-Tech SISP is October 28, 2024. Please refer to the SISP Procedure for further dates and details.

The bar date for pre-filing claims in the claims procedure is August 17, 2024. Please refer to the Claims Procedure for further dates and details.
